Chapter 7 Bankruptcy
This is known as a fresh start and involves a complete discharge on all unsecured obligations and secured obligations if the collateral is surrendered. You must meet an income threshold also known as a “means test” in order to exercise this option. There are some exceptions to discharge such as but not limited to taxes, child support, fraud, and student loans unless certain conditions are met.
Chapter 13 Bankruptcy
This is a reorganization of your debts, i.e. a payment plan over a 36 or 60 month time period with discharge of the debts, save for exceptions previously noted, at the conclusion the bankruptcy repayment period. The Chapter 13 option can be chosen but may be your only option if your income is above the “means test.”
